The International Federation for Human Rights (FIDH), within the framework of the Global Initiative Against Impunity (GIAI), and with the support of Parliamentarians for Global Action (PGA), publishes a proposal to ensure the future Convention on the Prevention and Punishment of Crimes against Humanity closes a critical gap in international criminal law by addressing direct and public incitement to crimes against humanity.

20 March 2026. As the 30 April 2026 deadline for States to submit formal amendment proposals to the Draft Articles on Prevention and Punishment of Crimes Against Humanity approaches, FIDH publishes a briefing note advancing a proposal to include an obligation to criminalise direct and public incitement to crimes against humanity as a standalone offence in the future Convention.

This briefing note, prepared by FIDH, and published within the framework of the Global Initiative Against Impunity (GIAI), and with the support of Parliamentarians for Global Action (PGA), outlines why the amendment proposal is grounded in established international criminal law and contributes to strengthening the future Convention’s objectives of strengthening the fight against impunity for crimes against humanity, but also of preventing such crimes. Aiming to prohibit incitement to crimes against humanity, it sets out:
 the absence of inchoate speech crimes in the current Draft Articles;
 the necessity for enhanced protection of civilians from direct and public exhortations to violence in times of mass violence;
 the importance of the future Convention to reflect the current state of international law; and
 necessary amendments to Draft Articles 4 and 6.
