Il Parlamento greco ha approvato una misura che sospende per tre mesi le domande di asilo per gli individui in arrivo dal Nord Africa, prevedendo la loro immediata espulsione dal Paese. INTERSOS, insieme a numerose altre organizzazioni, condannano questa disposizione come illegale e inammissibile, chiedendone l’immediato ritiro.
Le organizzazioni della Società Civile sottoscritte condannano come illegale e inammissibile la disposizione legislativa approvata dal Parlamento venerdì 11 luglio 2025 (articolo 79 della Legge 5218/2025), che sospende per tre mesi la presentazione delle domande di asilo da parte delle persone che arrivano nel Paese dal Nord Africa e prevede la loro immediata espulsione dal Paese senza registrazione.
I principi fondamentali del diritto di accesso all’asilo e di protezione dal refoulement non sono soggetti ad alcuna restrizione. Essi sono sanciti in testi sovra-legislativi del diritto internazionale e dell’UE che prevalgono su qualsiasi disposizione legale nazionale, come già sottolineato da autorevoli istituzioni in Grecia e a livello internazionale, tra cui il Difensore civico, la Commissione nazionale per i diritti umani, l’Associazione dei giudici amministrativi, la Sessione plenaria degli Ordini degli avvocati greci, il Commissario per i diritti umani del Consiglio d’Europa e l’Alto Commissariato delle Nazioni Unite per i Rifugiati.
Chiediamo al Governo greco di ritirare immediatamente questa legislazione illegale e alla Commissione europea di intraprendere azioni urgenti per far rispettare il diritto dell’UE e rimuovere immediatamente la violazione, in conformità con le sue responsabilità statutarie.
