GPAINNOVA’ affiliate Steros GPA Innovative S. L. (“Steros”), welcomes the provisional measures ordered on June 16, 2025 by the Hamburg Local Division of the Unified Patent Court (“UPC”) in relation to European Patent EP 4 249 647 (court ref. UPC_CFI_281/2025; ACT_14764/2025; Order No. ORD_28305/2025).
The Local Division concluded that the patent-in-suit, EP 4 249 647, which generally relates to electropolishing, in particular an electrolytic medium and an electropolishing process using such electrolytic medium, was infringed by OTEC, in particular by the electrolyte media “EF 16-11”.
As a result,, the Local Division ordered OTEC to cease and desist from manufacturing and/or offering, placing on the market or using or exporting or possessing for the purposes referred to in Austria, Belgium, Bulgaria, Denmark, Estonia, Finland, France, Germany, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Portugal, Romania, Slovenia, and Sweden, any electrolytic medium making use of the technical teaching of claim 1 of EP 4 249 647. The order of the Local Division has been enforced by Steros and must be observed by OTEC immediately. As required by the Rules of Procedure of the UPC, Steros will shortly commence proceedings on the merits to obtain a final resolution of the matter.
OTEC has appealed the decision (No. APL_30654/2025; UPC_CoA_579/2025) and additionally filed an application for suspensive effect of the appeal (No. App_30685/2025; UPC_CoA_581/2025) with the Court of Appeal in Luxembourg. Both the appeal and the application for suspensive effect of the appeal are still pending. OTEC may also – as a counterclaim in proceedings on the merits or independently – attack the validity of the patent-in-suit.
