GPAINNOVA Group, through its subsidiary DryLyte, S.L., announces that it has formally requested enforcement of the judgment issued by the Munich District Court I (Landgericht München I) on September 26th, docket no. 21 O 11216/23. In this decision, the Munich District Court found infringement of the German utility model DE 20 2017 007 610.1 “Smoothing and polishing device” in favour of DryLyte, S.L.
After reception of the enforceable copy, to be issued by the Court, GPAINNOVA will immediately proceed with the security deposit provision required under German law to enable the preliminary enforcement of the decision.
As a result of these steps, the first-instance judgment is expected to become effective in the coming weeks, which will preliminarily confer binding effects on the decision.
In the decision, the Court ordered OTEC inter alia to refrain from manufacturing, offering, marketing, or using in Germany –or importing and possessing for such purposes– a system for smoothing and polishing metal parts by electroerosion wherein ion transport takes place through solid bodies. Furthermore, the Court also ordered OTEC to provide DryLyte, S.L. with information and accounting concerning the infringement.
This action ensures that said Court orders shall be obeyed by OTEC, even during the pending appeal, further bolstering DryLyte’s position in safeguarding its proprietary technology and intellectual property.
The preliminary enforcement proceedings do not alter the fact that the decision is yet not final, as OTEC appealed the decision of the District Court.
